Electronic data discovery Interview - Michele Lange, Esq., is the director of legal technologies for Kroll Ontrack  (Part 2 of 2)

Michele C.S. Lange serves as a Director in the Ontrack® Discovery and Ontrack® Forensics product lines for Kroll Ontrack.  In this role, Ms. Lange is responsible for the evolution of the company's legal technology product and service offerings, conducts legal and market research and analysis, and engages in industry relations.  From e-document preservation to litigation tactics, she also helps clients integrate electronic discovery into their case strategy.

On the topics of electronic discovery, computer forensics, and technology's role in the law, Ms. Lange is among the nation's most knowledgeable experts. Most notably, she authored, along with her colleague, Kristin M. Nimsger, the American Bar Association book, entitled Electronic Evidence and Discovery: What Every Lawyer Should Know.  Further, her articles have appeared in the National Law Journal, New York Law Journal, Law.com, and Digital Discovery & E-Evidence, as well as numerous other publications.  Ms. Lange is frequently called upon by journalists to comment on cutting-edge law and technology developments, and she also routinely shares her expertise and knowledge as a guest speaker for legal associations, CLE programs and law school courses.

Ms. Lange graduated from the University of Wisconsin -- La Crosse with highest honors and the University of Minnesota Law School, cum laude.

Joshua Konkle: What is causing the need for intelligent preservation/collection by the corporation?

Michele Lange: Cost Containment.  eDiscovery can be costly if not well managed.  Focusing preservation and collection efforts to only documents that are most likely relevant will help a corporation maximize efficiency, mitigate risks and keep costs under control.  Sensible preparedness is a corporation's best ESI discovery cost savings strategy.

Joshua Konkle: There appears to be some gap between what legal teams require to support eDiscovery and the capabilities available today in data management technology.  What advice do you have as a vendor trying to assist their clients in addressing litigation readiness challenges?

Michele Lange: Given the rapid pace at which the eDiscovery industry has evolved, best practices and integrated technology solutions are still developing.  As such, seamless connections between data management systems and document production processes for discovery are minimal at best.  The best advice is to make sure that a corporation is leveraging any document management system they may have, while balancing the duty to fully comply with discovery obligations in litigation.   

Joshua Konkle: How are you dealing with the forensic collection of Enterprise Blogs and Wikis?

Michele Lange: We handle this type of ESI just like any other type of web-based content.  We have only seen minimal requests for this type of ESI.
